There are two types of speeding tickets in Illinois – petty and misdemeanor. A misdemeanor is the more serious or the two. It is often called “aggravated speeding.”
Aggravated speeding carries a possible sentence of time in jail. With that in mind, it’s important to understand the law around speeding violations and the penalties—and to be prepared to fight a citation.
Aggravated Speeding Violations and Punishments
If you are cited for driving 35 miles per hour or more over the limit, you are charged with a Class A Misdemeanor. This is punishable by up to a year in jail and a $2,500 fine, or some combination of the two.
If you are cited for driving 26-34 miles per hour over the posted speed limit, you are charged with a Class B Misdemeanor. This is punishable by up to 6 months in the county jail and a $1,500 fine, or some combination of the two.
As you can see, the penalties can be serious. Hiring a traffic defense lawyer is highly recommended.
Do You Need A Lawyer?
Yes. Most judges and prosecutors will require you to have a lawyer. This is due to the fact that jail time is a possible consequence. Since your freedom is potentially at risk, the court wants to make sure you have a proper defense and your interests are protected.

- Dismissed – this is the best potential outcome
- Amended – it is possible that the ticket may be amended to state a lower speed
- Supervision – this means you will not have a conviction on your record
- Driving School – it is possible that driving school will be required
- Community Service – it is possible that you can perform community service to improve your outcome
- Conviction – this may be on the aggravated speeding ticket or a lower, amended ticket
